Notice of Approval of a Transaction in the Class Action Regarding Fees Charged to Parents

On July 30, 2018, the Superior Court of Québec approved a settlement entered into by 68 Québec school boards and the representative of parents who have paid school fees for their children attending public elementary or secondary school.

The settlement provides that the 68 school boards will pay a total amount of $153,507,134, which will allow for the payment to parents of net indemnities of  $24.09 per student per school year of attendance between the 2009-2010 or 2010-2011 (depending on the school board) and 2016-2017 school years.

Parents do not have to register for the class action or to make a claim to receive the indemnities. These will be automatically distributed by Collectiva Class Action Services Inc.

Cheques in the amount of the indemnities will be sent by mail to the last persons registered in the files of the school boards as the “personne répondante” (person in charge) for the students covered by the class action.  A person who has paid school fees for a child, but who is not the person in charge on file must address his or her request to the person, who will be the other parent of the child in the vast majority of cases.

A joint cheque will be issued if multiple people are identified as persons in charge for the same student. A joint cheque must be signed by each of the identified recipients before being cashed. 

The cheques will be sent to the last known principal address recorded in the files of the students covered by the class action. In the event of a change of address, to ensure that the cheque is sent to their current address, the parents must, no later than January 21, 2019, advise Collectiva of such change by completing the form available on the class action web site, online at ententefraisscolaires.collectiva.ca/AddressChangeForm.

It is currently planned that the Cheques will be gradually mailed from February 2019 to June 20, 2019. This period could be extended by the Court if necessary.

The cheques must be cashed within 180 days (six months) of the date of issue. Otherwise, they will be cancelled and the parents will not be able to request that their indemnities be paid again.
